On Monday the 4th of April 2022, the EHRC published a new document it refers to as ‘a practical guide’ in applying the Equality Act when establishing or operating a single-sex services.
Upon review of the document, we do not find it to be appropriate in its stated aims. The document features concerning language, hypothetical scenarios and misrepresentation of existing law and policy that protects transgender people’s rights when accessing single-sex spaces.
These recommendations from the EHRC are not statutory, meaning they do not affect any existing legal protections against discrimination, such as the Equality Act.
